Sweepstakes Rules
NO PURCHASE NECESSARY. OPEN ONLY TO LEGAL RESIDENTS OF THE 48 CONTIGOUS UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE AT LEAST THE AGE OF MAJORITY IN HIS/HER/THEIR STATE OF RESIDENCE.
1) Sweepstakes Timing: The Make Over My Backyard Sweepstakes (the "Sweepstakes") begins 12:00 a.m. Eastern Time ("ET") on October 14, 2021 and ends at 11:59 p.m. ET on November 30, 2021 (the "Sweepstakes Period").
2) Eligibility: The Sweepstakes is open only to legal residents, of the 48 contiguous United States and the District of Columbia, who are at least the age of majority in his/her/their state/territory of residence. Employees of Conopco, Inc., d/b/a Unilever (the "Sponsor"), Don Jagoda Associates, Inc., their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies, including Southern Made Services, LLC DEJ Management, LLC, JR Motorsports, LLC, and their immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each (whether related or not), are not eligible to participate or win. Void in AK, HI and where prohibited by law. All federal, state, and local laws and regulations apply.
3) How to Enter: There are two (2) ways to enter, as follows:
- TO ENTER VIA QUALIFYING PURCHASE/THE WEBSITE: Beginning on October 14, 2021 and ending on November 30, 2021 you may purchase any one (1) participating* Hellmann's, Best Foods, Knorr or Lipton product at any physical Sam's Club location in the 48 contiguous U.S./DC or at www.samsclub.com (the "Qualifying Purchase"), during the Sweepstakes Period. Visit www.makeovermybackyard.com ("Website"), complete the online form and upload an image of your full receipt, or a screenshot of your shipping, pickup or delivery confirmation with respect to online orders, with qualifying Hellmann's, Best Foods, Knorr, or Lipton product starred by November 30, 2021. Image must include retailer name, date of purchase, time of purchase and qualifying products and be under 5MB and in the format of PNG, GIF or JPG. No manual reproductions of receipts will be accepted. Submissions are reviewed within 2-5 business days. Once your submission has been validated, you will receive an email confirming one (1) entry (the "receipt validation Entry") into the random drawing. Each receipt may only be submitted one (1) time. Offer qualification is determined when proof of purchase is submitted to offer website. Proof of identity and/or residence reasonably satisfactory to Sponsor and its agents may be required to verify eligibility. Sponsor and its agents have the right to determine Sweepstakes eligibility in their discretion; all decisions concerning Sweepstakes eligibility are final. Any effort to circumvent the Sweepstakes' limits, requirements or other terms (including, but not limited to, providing fictitious information or concealing identity or location) voids such Entry and disqualifies person from participating in the Sweepstakes.
- TO ENTER WITHOUT MAKING A QUALIFYING PURCHASE VIA MAIL-IN: To enter the Sweepstakes without making a purchase, hand print your first and last name, full address, date of birth, phone number (including area code) and email address on one 3" x 5" piece of paper and mail it in an envelope with proper first class postage affixed to: The Make Over My Backyard Sweepstakes, PO Box 90130, Nashville, TN 37209 ("mail-in Entry"). You will receive one (1) Entry into the random drawing for each qualifying mail-in Entry you submit in accordance with these instructions. Limit one (1) mail-in Entry per hand-addressed stamped envelope. All mail-in Entries must be handwritten and mail-in Entries must be postmarked by November 30, 2021 and received by December 7, 2021 to receive an Entry. All mail-in Entries become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due mail-in Entries, which will be disqualified.
Receipt validation Entries and mail-in Entries will be collectively referred to as "Entries". Limit one (1) Entry per household, regardless of entry method, using only one (1) email address. One (1) mail-in Entry per receipt submission. Must be a legal resident of one of the 48 contiguous United States. Sweepstakes excludes Hawaii and Alaska. Entries received from any person or email address in excess of the stated limitation will be void. All Sweepstakes Entries become property of the Sponsor and will not be returned. Sweepstakes Entries generated by script, macro or other automated means and Sweepstakes Entries by any means which subvert the entry process are void. By submitting a mail-in Entry, you agree to the Official Rules and are willing to provide your information to the Sponsor and its agents. No photocopied or mechanically reproduced mail-in Entries will be accepted. Normal Internet/phone access and data/usage charges imposed by your online/phone service may apply.

4) Random Drawing: On or about December 13, 2021, one (1) Grand Prize (as defined below) winner will be selected in a random drawing from among all eligible Entries received. Drawing will be conducted by Southern Made, LLC, an independent judging organization whose decisions are final on all matters relating to the Sweepstakes. Odds of winning the Grand Prize are dependent upon the number of eligible Entries received.
5) Grand Prize and Approximate Retail Value ("ARV"): Grand Prize (1): A 3-day/2-night trip for two (2) to Charlotte, NC. Trip is currently scheduled to take place in Spring 2022. A mutually agreed upon date will be arranged between the Grand Prize winner and Sponsor. Trip includes the following:
- Round-trip economy class air transportation from major airport nearest Grand Prize winner's home;
- Two (2) nights' hotel accommodations (one room based on double occupancy);
- A $500 travel stipend (to be used towards transportation, food, and beverages), awarded in the form of a Sponsor-selected gift card;
- A Sponsor-selected tour of JR Motorsports ("Tour");
- A $6,000 Shopping Trip to Sam's Club with JR Motorsports Driver, Justin Allgaier for an outdoor/backyard makeover (items will be shipped from Sam's Club to Grand Prize winner's home); and
- Sponsor-selected swag.
The ARV of the Grand Prize is $10,000. No transfer, substitution or cash equivalent for Grand Prize will be permitted, except at the sole discretion of the Sponsor. In such circumstance, an alternate Grand Prize/Grand Prize component of equal value will be awarded and the Sponsor's obligation to the Grand Prize winner will be fulfilled. In the event the Tour is cancelled for reasons outside of the Sponsor's control, that/those portion(s) of the Grand Prize will not be awarded. In the event Justin Allgaier is not available for the shopping trip, shopping trip will still be awarded and winner will be unaccompanied and no additional compensation will be provided. No other additional compensation will be provided. Acceptance of Grand Prize constitutes permission for the Sponsor and its agencies to use Grand Prize winner's name, likeness, and Grand Prize Footage (as defined below) for purposes of advertising and trade without further compensation, unless prohibited by law.
6) Grand Prize Rules: Grand Prize winner and his/her travel companion agrees that Sponsor or its agents may photograph, videotape or record any aspects of the Grand Prize trip (including the shopping trip with Justin Allgaier) ("Grand Prize footage") and use that Grand Prize footage or excerpts of that Grand Prize footage in any way they see fit. Airline carrier's regulations and conditions apply. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Grand Prize winner and travel companion must possess valid travel documents (i.e., valid government issued photo ID) in order to travel. Seat selection and exact timing of trip subject to availability and confirmation of reservations. Certain restrictions apply. Trip must be taken on dates specified by Sponsor, currently scheduled for Spring 2022, or Grand Prize will be forfeited. Travel must be round trip. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. No refunds or credit for changes are allowed. In the event Grand Prize winner lives within a 150-mile radius of Charlotte, NC, round-trip ground transportation will be provided in lieu of air transportation and no additional compensation will be provided for air transportation portion of Grand Prize. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, tips, meals, incidentals, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges, personal charges at lodging, security fees, entertainment and transfers, are Grand Prize winner's sole responsibility. Unless the child/charge of Grand Prize winner, travel companion must be eighteen (18) years of age or older. All travelers must also pass any required medical testing and comply with any additional requirements, at any time, that may be required or recommended by any government agency, airline, or Sponsor, including without limitation, passing one or more COVID-19 antigen and screening tests, and testing negative for COVID-19 or having been vaccinated against COVID-19. Travelers may also be required to execute any assumption of risk and/or other documents relating to COVID-19 or he/she may not be permitted to travel or participate in the Tour/shopping trip with Justin Allgaier.
7) General Rules: Potential Grand Prize winner will be notified by email and phone. The potential Grand Prize winner will be required to complete a Declaration of Eligibility, Release of Liability and a Publicity Release (where legal) within forty-eight (48) hours of notification attempt or else Grand Prize will be forfeited and an alternate Grand Prize winner may be selected from among all eligible entrants. Failure to reach Grand Prize winner within this timeframe or return of Grand Prize notification as undeliverable may result in disqualification and an alternate winner may be selected. Grand Prize winner/travel companion may also be required to execute and return any required releases/waivers as required by JR Motorsports. Grand Prize Winner's travel companion (or Grand Prize winner on behalf of minor travel companion who is Grand Prize winner's child/charge) must execute and return a release of liability prior to travel. By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and Administrator. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Entries become the property of the Sponsor. The Sponsor and their agencies and Administrator are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Website or the Sweepstakes or by any human error which may occur in the processing of the Entries in the Sweepstakes or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the Website or Sweepstakes. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. "Authorized account holder" of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor, and/or Administrator (as identified in these Official Rules) are not responsible for the failure of any email or Entry to be received by Sponsor/Administrator on account of technical problems or congestion on the internet or at any website. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or Website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to undermine the legitimate operation of the Sweepstakes or Website may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes or Website, then the Sponsor reserves the right at its sole discretion to cancel the Sweepstakes and select the Grand Prize winner at random from among all eligible Entries received/postmarked prior to cancellation. By entering the Sweepstakes, you hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents.
8) Release and Limitations of Liability: By participating in the Sweepstakes, the entrant agrees that Sponsor, Administrator, Fandango Loyalty Solutions, LLC, Don Jagoda Associates, Inc., DEJ Management, LLC, JR Motorsports, LLC, and their respective parents, subsidiaries, affiliated companies, agents, retailers, advertising and Sweepstakes agencies, and all of their respective shareholders, officers, directors, employees and assigns, members, representatives and agents (the "Released Parties"), will have no liability whatsoever for, and will be held harmless by entrant for any liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property, damages sustained due in whole or in part, directly or indirectly, from entry creation, the acceptance, possession, use or misuse of the Grand Prize or parts thereof, if applicable or participation in the Sweepstakes or participation in any Sweepstakes or related activity. Entrants further agree that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorneys' fees. Entrants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
9) Governing Law, Jurisdiction and Venue: SPONSOR IS REGISTERED UNDER THE LAWS OF THE UNITED STATES WITH HEADQUARTERS IN NEW JERSEY. THE NEW JERSEY COURTS (STATE & FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW JERSEY SHALL GOVERN THE SAME. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND HEREBY IRREVOCABLY SUBMITS TO THE VENUE OF THOSE COURTS WITHIN NEW JERSEY.
10) Entrants' Personal Information: Information collected from entrants is subject to Sponsor's Privacy Policy, located at https://www.unilevernotices.com/usa/english/privacy-notice/notice.html.
11) Grand Prize Winner: For the Grand Prize winner's name, available after December 15, 2021, send a self-addressed stamped envelope no later than December 31, 2021, to: Make Over my Backyard Sweepstakes Grand Prize Winner, 100 Marcus Drive (Dept. DE), Melville, NY 11747.
12) Sponsor: The Sponsor of the Sweepstakes is Conopco, Inc., d/b/a Unilever, 800 Sylvan Ave., Englewood Cliffs, NJ 07632. Fandango and Fandango Loyalty Solutions, LLC, or their parents, affiliates, and subsidiaries are not a sponsor or co-sponsor of this Sweepstakes and are not responsible for the promotion, administration or execution of this Sweepstakes.
